NOTICE IS HEREBY GIVEN under Section 467 of the Local Government Act, that the Municipality of North Cowichan Council will consider first readings of “Zoning Amendment Bylaw No. 3940, 2023” and “Zoning Amendment Bylaw No. 3944, 2023” during their regular Council meeting to be held at 5:00 p.m. on Wednesday, January 17, 2024. Council is authorized under Section 135 of the Community Charter and Section 480 of the Local Government Act, to give the Bylaws up to three readings at this meeting. If the Bylaws are given third reading at this meeting, Council may adopt the Bylaws at that time.

NOTICE IS HEREBY GIVEN that Council is prohibited from holding Public Hearings for these Bylaws under Section 464 (3) of the Local Government Act.

The regular Council meeting, as authorized by Section 128 of the Community Charter, will be conducted by video conference using the Cisco Webex platform, and though electronic, is open to the public and anyone wishing to participate may do so in person by attending Council Chambers, or by joining the meeting using a computer, smartphone, or tablet. You may also view the meeting as it is streamed live by going to www.northcowichan.ca/Agendas and click on the ‘View Live Stream’ link. A copy of the recording will be made available after the meeting on North Cowichan’s website for on-demand viewing.

Zoning Amendment Bylaw No. 3940 (3110 Chapman Road), 2023

The purpose of proposed Zoning Amendment Bylaw No. 3940, 2023 is to amend Zoning Bylaw 1997, No. 2950 by reclassifying 3110 Chapman Road, Chemainus, B.C. (PID: 014-381-460) from Residential One- and Two-Family Zone (R3) to Infill Residential Neighbourhood Zone (R3-N) to allow for a detached accessory dwelling unit on the subject property (PID: 014-381-460) as shown outlined in bold on the map.

Zoning Amendment Bylaw No. 3944 (1935 Maple Bay Road), 2023

The purpose of the proposed Zoning Amendment Bylaw No. 3944 is to amend Zoning Bylaw 1997, No. 2950, Section 56(4)(a) [Density in the Residential Rural Zone (R1)] by adding subsection: “(o) Despite Section 56(4)(a), a total combined maximum of two dwelling units within a maximum of two residential buildings is permitted on 1935 Maple Bay Road, Duncan, B.C. (PID: 001-526-031)”. The subject property is shown outlined in bold on the map.

Copies of the Bylaws can be viewed online by going to https://www.northcowichan.ca/municipal-hall/news/news-archive. The Bylaws can also be viewed in the Planning Department at the Municipal Hall, Monday to Friday (excluding statutory holidays) from January 2, 2024 to January 17, 2024 between 8:30 a.m. and 4:30 p.m. You may also request a copy of the Bylaw by emailing planning@northcowichan.ca.

This notice is given as required by Section 467 of the Local Government Act.
